1. About the Service and Legal Contracting Party
Ricky Burd Babysitting is a personal babysitting service provided by Rhiannon Rose Burd, a minor. Under California law, minors lack the legal capacity to enter into binding contracts. All contractual commitments, agreements, and legal obligations related to this service are made by and are the responsibility of Matt Burd, her parent and legal guardian, on her behalf.
Nothing on this Site constitutes a binding service agreement until both parties have confirmed the booking details in writing via email or text message.
2. Use of the Site
You may use this Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law or regulation
- Submit false, misleading, or fraudulent information through any Site form or contact channel
- Attempt to gain unauthorized access to any part of the Site or its systems
- Transmit harmful, offensive, threatening, or abusive content
- Reproduce, distribute, or exploit Site content for commercial purposes without prior written permission from Matt Burd
3. Intellectual Property
All content on this Site — including text, photographs, graphics, design, and layout — is the property of Ricky Burd Babysitting or its respective content suppliers and is protected by applicable intellectual property law. You may not copy, modify, distribute, or exploit Site content without prior written permission.
4. Babysitting Services — Terms and Acknowledgments
By inquiring about or booking babysitting services through this Site, you acknowledge and agree to the following:
a) Minor Operator — Rhiannon Rose Burd ("Ricky") is a minor providing babysitting services as a personal endeavor under the parental supervision of Matt Burd. All contractual commitments are made by Matt Burd on her behalf.
b) Booking Confirmation — A babysitting engagement is not confirmed until both parties agree to the specific date, time, location, rate, and terms in writing via email or text message. Verbal agreements are not binding under these Terms.
c) Parental Responsibility — Parents and guardians who hire Ricky retain full legal responsibility for their children at all times. Ricky provides attentive care in good faith but is not a licensed childcare provider, medical professional, or emergency responder.
d) Emergency Medical Situations — In the event of a medical emergency, Ricky will immediately contact the child's parent or guardian. If the parent or guardian is unreachable, Ricky will contact 911. Ricky, as a minor, cannot provide medical consent for another child. Parents must execute a written Emergency Medical Authorization at the time of booking authorizing emergency services to be sought on behalf of their child. (See the Booking Agreement.)
e) Safe Environment — Parents agree to provide Ricky with a safe and appropriate working environment, including functional smoke and CO detectors, adequate lighting, access to emergency supplies and a first aid kit, and clear exit routes.
f) Ricky's Right to Withdraw — Ricky and Matt Burd reserve the right to end any babysitting engagement and contact a parent to return home immediately if the environment becomes unsafe, threatening, or otherwise inappropriate — including but not limited to an intoxicated adult on the premises without another responsible adult present. No cancellation fee applies to Ricky-initiated withdrawals for safety reasons.
g) Scope of Duties — Ricky's responsibilities are limited to the supervision and care of the named children during the agreed hours. Ricky is not obligated to perform household cleaning, laundry, cooking beyond basic child meal preparation, or other tasks outside the scope of childcare unless explicitly agreed upon in writing before the engagement.
h) Photographs and Social Media — Ricky will not photograph, record, or post images or videos of children in her care on any social media platform, website, or communication channel without the explicit prior written consent of the parent or guardian.
i) Payment — Payment is accepted via cash, check (payable to Matt Burd), Venmo, or Zelle as agreed at the time of booking. Payment accounts are held by Matt Burd as Ricky's parent and legal guardian. Payment is due at the conclusion of each engagement.
5. Cancellations
a) Cancellation by Parent — We understand plans change. We ask for as much notice as possible. No cancellation fee is charged for any cancellation given at least 24 hours before the scheduled start time. Repeated last-minute cancellations (less than 24 hours' notice) may affect future availability at our discretion.
b) Cancellation by Ricky / Matt Burd — We will make every effort to honor confirmed bookings. If Ricky is ill, has a family emergency, or the engagement must be cancelled for reasons beyond our control (including severe weather, natural disaster, or other force majeure events), we will notify the parent as soon as possible. No fee is charged for Ricky-initiated cancellations.
6. Disclaimers
This Site and the services described herein are provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of fitness for a particular purpose or non-infringement.
Ricky Burd Babysitting makes no warranty that the Site will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable California law, Matt Burd and Ricky Burd Babysitting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or the services described herein, including but not limited to loss of data, loss of revenue, or personal injury.
Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California. In the event of a dispute, both parties agree to first attempt resolution in good faith through direct communication. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in San Diego County, California, under the rules of the American Arbitration Association, before either party initiates litigation. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
9. Changes to These Terms
We may update these Terms periodically. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
